I’m not even close to being a lawyer, but when a judge throws down the hammer and states you must stop saying you’re the “most reliable” because your new HSPA network is too new… I gotta believe it’s a done deal. No room for negotiations.
Last month Rogers took Bell to court for false claims about being the “most reliable” network in Canada. They won the suit and Bell was forced to remove the claim from all advertising. Even Wade Oosterman, President of Bell Mobility stated “based on the judge’s ruling, network tenure is now an issue in claiming that a network is most reliable. In other words, the reliability of a brand new network cannot now be directly compared to an older network. We don’t agree of course and are considering an appeal… We’ll continue to let clients across Canada know about the new network’s superiority of course. Most reliable can wait for another day.”
I guess today was that day because I got a nice piece of advertising that boldly stated “The New Network. It’s the fastest. It’s the largest. It’s the most reliable. It’s global.”
Perhaps I’m missing something or Bell has a cutoff date that gives them allowance to use “most reliable”. If there are any lawyers are out there we’d love to hear from you! Check it out below:

It was probably printed before the courts decided.
On everything I’ve seen recently they have removed the reliable claim.
Even their website doesn’t have it any more.

I thought the courts just said they had to stop saying Bell has the most reliable network. Nothing about HSPA being the most reliable type of network.

At my work ((Rogers/Fido call center)) there must be at least 500+ posters, banners, flyers, booklets etc etc Still showing ” Rogers, Canada’s Most Reliable Network ” i’v said something.. ((jokingly to my peers)) and not that its in open public.. But its Still plastered everywhere & they allso lost that right in court and it should be removed aswell

Yeah, on the TELUS side, we got a super urgent bulletin, telling us to take down some coverage maps, so I figured that was TELUS’s flavour of response to injunctions like that anyhow…
It’s all spin anyhow, so, whatever, as long as it keeps getting faster and more stable, I’m happy.

The Blackberrys in the picture aren’t even on the new network… that’s a bigger issue than the BS claim of most reliable.

From what I understand, there is a grace period in which Bell has to remove all their ads that have this network claim. But that grace period was only a couple of weeks (i think). When courts say all ads with this claim must be removed, they mean ALL of it, doesn’t matter if they produced it before or after the ruling. (this only includes distribution channels that are controllable, so garbage flying around on the streets don’t count)
