After a United States federal appeals court rejected Samsung’s request to re-examine its patent case against Apple, the company now plans to ask the U.S. Supreme Court to look at the case, according to court documents obtained by the San Jose Mercury News.
“The questions present issues of enormous importance to patent litigation and the scope of innovation, especially in high-technology industries,” says the document penned by Samsung’s legal team.
Samsung’s patent battle with Apple has been ongoing since 2012. The initial court that looked at the case ruled in favour of Apple and awarded the Cupertino-based company $1-billion in damages, but subsequent rulings reduced that amount to $548-million. Samsung, however, has spent the past several years attempting to get the case dismissed altogether.
For its most recent appeal, which, as mentioned earlier, was rejected by the United States Federal Circuit of Appeals, high profile Silicon Valley firms like Facebook and Google asked the court to dismiss the case in favour of Samsung. Those same companies are expected to advise the Supreme Court to do the same.
Should it decide to look at the case, the Supreme Court will set the stage for one of the most high-profile legal showdowns involving two tech firms. The earliest we can expect the court to announce whether it it will look at the case is next June.
