Palm Pre New Promo plan?

Hi Guys, This is my first post and wanted to know if you bought a palm pre on a 3 year and got the phone for $0 and the plan 50 for $35. Would you be able to switch the phone out with an unlocked smart phone and still have the $35 dollar new promo plan?

the system would realize this.

palm pre = cdma device
unlocked smartphone = hspa device

as soon as you switch hardware that promotion would automatically drop off.
